These terms are an agreement between you and us about using Kymo, the breathwork app, and its website. By downloading or using Kymo you agree to them. They’re written to be read, so they’re short.
1. Which license applies
- If you got Kymo from the App Store, your license to use it is Apple’s Standard Licensed Application End User License Agreement (“Apple’s EULA”): www.apple.com/legal/internet-services/itunes/dev/stdeula/. These terms add to Apple’s EULA. If anything here conflicts with it, Apple’s EULA wins. The license is between you and us, not Apple, and we, not Apple, are responsible for Kymo and its content.
- If you got Kymo from Google Play, these terms are the license agreement between you and us, and Google Play’s terms of service govern your purchase.
Either way, we give you a personal, non-exclusive, non-transferable, revocable license to use Kymo on devices you own or control, for your own non-commercial use.
2. A wellness app, not medical care
Kymo is for relaxation and wellbeing. It is not a medical device. It doesn’t diagnose, treat or prevent anything, and nothing in it is medical advice.
- Heart readings are estimates. Heart rate and heart-rate variability are estimated from your phone’s camera and can differ from a watch, chest strap or clinical device. They aren’t for diagnosing or monitoring any condition. Check with a doctor before making health decisions.
- Breathe gently. Breathe comfortably and never force it. If you feel dizzy, light-headed, tingly or short of breath, stop and breathe normally.
- Fast breathing and long holds. Sit or lie down. Never practice in or near water, while driving, or while doing anything that needs your full attention. If you’re pregnant, or have a heart, lung or seizure condition, check with your doctor before breath holds or fast breathing.
- Binaural beats are for relaxation, not a treatment for anything. Use them with headphones at a comfortable volume, and never while driving.
- The flash can get warm during a heart reading; stop if it’s uncomfortable.
- If anxiety, low mood or sleep problems feel overwhelming or keep coming back, talk to a doctor or someone you trust. In an emergency, call your local emergency number.
You decide whether a technique is right for you, and you use Kymo at your own risk.
3. No account
Kymo has no accounts. Your practice is stored on your phone (see our Privacy Policy), so keeping your phone and its backups safe is up to you. If you delete the app or use Settings › Erase all data, that history can’t be recovered by us. Your subscription isn’t affected and can be restored.
4. Kymo Premium
- What’s free stays free. The five Moments, Quick relief, heart readings, the morning check-in and the core practice are free without a subscription.
- Plans. Kymo Premium is an auto-renewing subscription, billed yearly or monthly. The yearly plan may include a free trial for new subscribers; the store shows whether you’re eligible before you confirm. Prices are shown in the app and on the store’s purchase sheet in your local currency, including any taxes the store applies.
- Billing. Payment is charged to your Apple Account or Google account when you confirm the purchase, or when a free trial ends.
- Renewal. The subscription renews automatically for the same length and at the then-current price unless you cancel at least 24 hours before the end of the current period or trial. Your account is charged for the renewal within the 24 hours before the period ends. If the price ever goes up, the store tells you first and, where the law or the store requires it, asks for your agreement.
- Cancel or manage at any time: on iPhone in Settings › your name › Subscriptions, on Android in Google Play › Payments & subscriptions › Subscriptions, or from Kymo’s Settings › Kymo Premium. Canceling stops the next renewal; you keep Premium until the end of the period you’ve paid for. Any unused part of a free trial ends when you buy a subscription.
- Refunds are handled by Apple or Google under their policies (on iPhone at reportaproblem.apple.com); we can’t issue them directly. Your rights under consumer law where you live are unaffected.
- If Premium ends, your history and patterns stay on your phone; premium items lock again, and choices that used them fall back to free ones.
- Offer codes are subject to the terms shown when you redeem them, can’t be exchanged for cash and may expire.
- Family Sharing applies only if the App Store listing says the subscription supports it.
5. Acceptable use
Please don’t: copy, resell, rent or redistribute Kymo or its content; extract the visuals, soundscapes, guide voices or code (including by reverse engineering, except where the law allows it); get around the subscription or any limit; use Kymo to break the law; or use breathe-with-me links to send names or messages that are unlawful, harassing or that infringe someone else’s rights.
6. Your content and sharing
The patterns you build, the names you give them and the cards and links you share are yours. Shared cards and links go wherever you send them through your phone’s share sheet; we don’t host or review them. A breathe-with-me link carries a breathing pattern, its visual and its name, never your readings.
7. Our content
Kymo’s visuals, soundscapes, guide voices, techniques, programs, text, design and name belong to us or our licensors and are protected by intellectual property law. The guide voices are made with AI voice technology (ElevenLabs) and licensed for use in Kymo. The fonts are used under the SIL Open Font License. The explainers cite their sources inside the app (Settings › Sources). Nothing in these terms gives you rights in our content beyond the license in section 1.
8. Changes to Kymo and to these terms
We work to keep Kymo running well, but features may change, improve or be retired, and Kymo may be unavailable at times. We may update these terms. If a change is material, we’ll tell you in the app or the release notes before it takes effect. If you don’t agree, stop using Kymo and cancel your subscription; continuing to use it after the change means you accept the updated terms.
9. Disclaimer
To the extent the law allows, Kymo is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of heart readings. Some places don’t allow these exclusions, so they may not all apply to you. On the App Store, if Kymo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for Kymo.
10. Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for losses arising from how you choose to use the breathing techniques or the readings, and our total liability to you for any claim about Kymo is limited to the amount you paid for Kymo Premium in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law (for example for death or personal injury caused by negligence, or for fraud), or your rights under the consumer law of the country where you live.
11. Governing law
These terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-law rules, and disputes go to the courts there. If you’re a consumer in the EU, the UK or another place that gives you the right, you can also bring a claim in the courts where you live, and the mandatory consumer protections of that place still apply to you.
12. Third parties and the store terms
You must also follow the terms of the store you got Kymo from. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms for App Store users and may enforce them against you. You confirm that you’re not in a country under a US government embargo or on a US list of prohibited or restricted parties. Questions, complaints or claims about Kymo go to us, not Apple or Google, including any claim that Kymo infringes someone’s intellectual property, product liability claims and claims under consumer or privacy law.
13. General
If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we haven’t given up the right to. You can’t transfer these terms; we may transfer them to whoever takes over Kymo, with notice in the app. These terms, Apple’s EULA where it applies and our Privacy Policy are the whole agreement about Kymo.
